Report Infringement Policy

At Hungamastart, we take the protection of intellectual property rights very seriously. We are committed to ensuring that all products listed on our platform respect copyrights, trademarks, and other intellectual property rights. This policy outlines the process for reporting infringement and the steps we take to address such reports.

1. What is Intellectual Property (IP) Infringement?

Intellectual property (IP) infringement occurs when a third party uses, sells, or distributes someone else’s protected work without permission. This includes violations related to:

  • Copyright: Unauthorized use of original literary, artistic, musical, or other creative works.
  • Trademark: Use of a brand’s name, logo, or design that may confuse consumers.
  • Patents: Unauthorized use of a patented invention or design.
  • Designs: Use of registered designs without permission.

2. How to Report an Infringement

    • Suspend or terminate the seller’s account if repeat violations occur.
    • Notify you of the actions taken.

4. Consequences of Filing False Claims

Filing a false infringement claim can have serious legal consequences. If you knowingly submit a false or misleading claim of infringement, you may be held liable for damages, including legal costs. To avoid this, ensure that your claim is legitimate, and you have sufficient proof of ownership or authorization to make the report.

5. Counter-Notice from Sellers

If a seller believes that their product or content was wrongfully removed due to a false infringement claim, they can submit a counter-notice. The counter-notice must include:

  • Seller’s Information: Full name, contact details, and any business details.
  • Details of the Removed Product: Description of the removed content and where it was located on our platform.
  • Statement of Good Faith: A statement declaring under penalty of perjury that the content was removed by mistake or misidentification.
  • Consent to Jurisdiction: Consent to the jurisdiction of the appropriate court and agreement to accept service of process from the complainant.
